Our representation frequently begins upon a carrier's first receipt of the notice of a claim, which allows us to provide advice during the investigation into the underlying facts, communicate and work with public adjusters, evaluate the extent and scope of a loss, assess code compliance and related costs, and evaluate complex issues which may affect whether litigation will be necessary to resolve the claim and any coverage issues. We are often involved in assessing issues such as: concurrent causation, repair versus replacement, valuation costs, calculating ACV versus RCV, coinsurance, building vacancies, and the application of various exclusions, such as: utility services, wear and tear, faulty maintenance, water-related damage, cracking/shrinking, dishonest or criminal acts, and environmental contamination.
