Mr. Marshall has a diverse litigation and mediation practice representing construction companies, corporations, condominium associations, and licensed professionals in contract, tort and fraud-based litigation. He represents a variety of design professionals, including architects, professional and structural engineers, land surveyors, and designers builders, in the areas of breach of contract, construction delay claims, professional negligence, fraud, and mechanic’s liens. Mr. Marshall has tried bench and jury cases and arbitrations, and has negotiated hundreds of settlements through both formal and informal mediation. He also drafts and negotiates design and construction contracts for his clients, with particular expertise in contract negotiation on behalf of hospitals and health care organizations.
Mr. Marshall’s commercial litigation work concentrates in the areas of business torts, regulatory compliance, breach of contract, consumer claims, and business fraud, with a particular strength in defending clients against actions brought under the Illinois Consumer Fraud Act and various state professional licensing statutes. Mr. Marshall has been successful in mitigating clients’ exposure under these statutes, some of which permit plaintiffs to seek punitive damages and attorney’s fees in addition to compensatory damages. He serves as a risk management consultant and member of a “hot line” team for clients to proactively address and negotiate claims and disputes before they evolve into expensive lawsuits.
Mr. Marshall frequently lectures on contract negotiation, litigation techniques, risk management, and professional liability to real estate, construction, design, and healthcare associations and their members, which enable these professionals to obtain their required continuing education and licensing credits and maintain their business in a manner which limits exposure to legal claims. He has published articles in real estate publications, such as Realtor® Magazine, Broker to Broker, and Real Estate Finance, and is also the co author of an Illinois Institute for Continuing Education chapter entitled, “Condominium Litigation.”
Mr. Marshall completed intensive training in mediation and negotiation at Pepperdine University School of Law’s top ranked Straus Institute for Dispute Resolution in 2005, and is a Certified Mediator in the Cook County Court-Annexed Major Case Civil Mediation Program.
Mr. Marshall is a member of the American Bar Association, Illinois Association of Defense Trial Council, Professional Liability Underwriting Society, American Institute of Architects, and the National Association of Home Builders. He is also a member of the Chicago Bar Association, and is a founding member of its Commercial Litigation Committee.
